An uncontested divorce is a divorce where both parties are in agreement and are ready, willing and able to cooperate with each other. Uncontested divorces offer great advantages in terms of speed, low cost and certainty of result since the two parties are not litigating.
When both parties are willing to work together to resolve differences in an amicable fashion, we can prepare all the necessary legal documents in an expeditious fashion. Both parties then need only to sign and notarize the divorce documents so we can submit them to the court. Another advantage of uncontested divorces in New York is that you do not have to make a court appearance.
I provide expert guidance to clients to make sure all the necessary issues are resolved prior to filing the divorce papers, including:
Both contested and uncontested divorces involve the same issues of child support and visitation, child support, property distribution and spousal support. The difference between an uncontested divorce and a contested divorce is that the two parties have mutually agreed in order to avoid litigation.
My mission is to prepare and process uncontested divorces in an expeditious manner so the partners can move on with their lives as soon as possible while at the least cost to them financially, emotionally, and psychologically. Uncontested divorces also spare children from being subject to a custody dispute. I do find that an agreement between parties is usually preferable to having a stranger, such as a judge, make a final determination on people?s lives when he doesn?t even know the two people involved. Unfortunately, uncontested divorces are not always possible. In these cases, I will represent you in a contested divorce.
